The BtMG does not list 4-Pro-MET by name in any of its three schedules (Anlagen I�III). Germany's narcotics law relies on explicit compound listings, not structural group bans. As of April 2026, the BtMG Anlage I contains approximately 640 individually named substances. 4-Propionyloxy-N-methyl-N-ethyltryptamine isn't among them.

How the BtMG Schedules Work

Three categories divide the controlled substances: Anlage I (non-prescribable narcotics), Anlage II (marketable but prescription-only), and Anlage III (prescription narcotics). It doesn't automatically extend to other 4-acyloxy tryptamines with different N-alkyl substitution patterns.

Could 4-Pro-MET Be Added to the BtMG?

In theory, yes. The BfArM monitors novel psychoactive compounds through the EU Early Warning System, which reported over 50 new synthetic compounds in 2025 alone. But scheduling typically follows evidence of widespread use or documented harm. Community survey data suggests 4-Pro-MET usage stays niche – estimated at fewer than 5,000 users across the DACH region – which likely lowers its scheduling priority.

The NpSG, enacted in November 2016, works differently. Instead of listing individual compounds, it defines entire structural groups. For tryptamines, the relevant definition is Substance Group 5.1 (Indol-3-alkylamines). It specifies an indole core structure and exhaustively lists the permitted substituents at positions 4–7 of the indole ring (the so-called Rn substituents).

Why 4-Pro-MET Falls Outside the NpSG

The Rn substituent list in Substance Group 5.1 reads: ?Hydrogen, fluorine, chlorine, bromine, iodine, alkyl (up to C4), alkyloxy (up to C10), benzyloxy, carboxamido, methoxy, trialkylsilyl, trifluoromethyl, trifluoromethoxy, acetoxy, hydroxy, and methylthio groups.? Only acetoxy (the acetic acid ester, C2) is listed – propionyloxy (the propionic acid ester, C3) is absent. Because 4-Pro-MET carries a propionyloxy group at position 4 of the indole ring, and this substituent isn't among the enumerated Rn options, the substance falls outside the definition. The 6th NpSG Amendment (published December 1, 2025; effective April 12, 2026) added trialkylsilyl, trifluoromethyl, and trifluoromethoxy to the list but did not add propionyloxy.

What the NpSG Actually Prohibits

The NpSG criminalizes trading, manufacturing for trade, or importing covered substances – but personal possession is not an offense under this law (unlike the BtMG). So even if 4-Pro-MET were reclassified in a future amendment, legal consequences would apply to commercial activity, not personal possession. One caveat: the Bundesgesundheitsministerium can close this gap at any time by adding propionyloxy or a broader ?alkanoyloxy? term to the Rn list.

Wetswijzigingen in Duitsland vereisen doorgaans een aanlooptijd van 6–18 maanden – van de aanbeveling van de deskundigencommissie via het ontwerp tot de publicatie in het Bundesgesetzblatt. Dus geen wijzigingen van de ene dag op de andere.

• BtMG-uitbreiding: Een naamelijke opname van 4-Pro-MET is theoretisch mogelijk, maar vereist een aanbeveling van de deskundigencommissie. Geringe marktaanwezigheid, geen meldingen van gezondheidsincidenten – op korte termijn onwaarschijnlijk. De EMCDDA/EUDA heeft 4-Pro-MET tot nu toe niet opgenomen in haar vroegtijdig waarschuwingssysteem (EU Early Warning System).
• NpSG-hervorming: Een uitbreiding van de stofgroepdefinities zou in de toekomst ook tryptamines zonder oxo-zijketen kunnen omvatten. Discussies hierover lopen op EU-niveau sinds 2023, in het kader van de EU-drugsverordening. Dat zou de juridische situatie voor 4-Pro-MET volledig veranderen – maar is momenteel niet besloten.
• EU-brede harmonisering: De EU-drugsverordening (Verordening 2023/2127) zou op middellange termijn nationale regelgeving kunnen beïnvloeden. De EUDA monitort voortdurend nieuwe stoffen en geeft aanbevelingen aan lidstaten. Tot nu toe heeft de EUDA geen risicobeoordeling voor 4-Pro-MET uitgevoerd.
• Algeheel verbod-modellen: Sommige EU-landen (Ierland, VK) hanteren algemene verboden. In Duitsland wordt dit door rechtsexperts als onwaarschijnlijk beschouwd – grondwettelijke bezwaren op het gebied van de bepaaldheid van het strafrecht spreken daartegen.
